General terms and conditions of business
1. Scope
These Terms and Conditions (T&C) apply to all deliveries from We Love Lashes to consumers.

You acknowledge and agree that these Terms and Conditions constitute the complete and exclusive agreement between you and us regarding your use of the website and replace all previous proposals, agreements, and communications.
We reserve the right to amend these Terms of Use at any time at our sole discretion. All changes take effect immediately upon publication on the website and notification of the amendments. By continuing to use the website after the amendments take effect, you agree to the revised Terms and Conditions.
We are entitled to revoke rights granted under these Terms and Conditions without prior notice. The affected provision shall be modified so that the original intent of the parties is preserved as far as possible.
4. Offer and Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to submit an order. All offers are valid while stocks last. Errors excepted.
5. Your Account
If you are at least 16 years old, you may register on our website. Do not register if you are under 16 years of age. After registration, you can access your account using your email address/username and a password. You are responsible for maintaining the confidentiality of your account, username, and password, and for restricting access to your computer. It is your responsibility to keep this information current, complete, accurate, and truthful. You agree to take responsibility for all activities that occur under your account, username, and/or password. You agree to provide only current, complete, accurate, and truthful information. We strive to describe our products as accurately as possible. Nevertheless, we cannot guarantee that product descriptions, colors, information, or other content available on the website are accurate, complete, reliable, current, or error-free.
7. Products and Services for Personal Use
The products, services, and samples offered on the website are intended solely for personal use. It is not permitted to sell or resell any services or samples you receive from us. We reserve the right, at our sole discretion, to cancel orders or reduce quantities with or without prior notice if we believe they violate our Terms and Conditions. Samples are available only while supplies last.
8. Orders
By clicking the “Submit Order” button in the final step of the ordering process, you place a binding order for the goods contained in your shopping cart. The purchase contract is concluded once we accept your order by sending an order confirmation via email immediately after receiving your order.
9. Payment
Payment can be made in advance, by credit card, or via TWINT.
10. Prices and Shipping Costs
The prices listed on the product pages include statutory VAT. Shipping costs for deliveries within Switzerland are CHF 8.50.
11. Retention of Title
The goods remain our property until full payment has been received.
12. Delivery
Delivery is made within Switzerland. The delivery time is approximately 2 to 5 working days from the order date.
13. Refusal of Acceptance
If the customer refuses to accept the ordered goods without having canceled the order before shipment, we will charge a processing fee of CHF 40.00.
14. Right of Set-Off
You are entitled to set-off only if your counterclaims have been legally established by a court, are undisputed, or have been acknowledged by us in writing.
13. Compensation
You agree to indemnify and hold us and our partners, employees, agents, and licensors harmless from and against any losses, damages, claims, fines, or costs, including reasonable attorney’s fees, arising from actions, claims, or demands of third parties due to your (or persons acting under your account) use of the website, any user content made available on the website, or violations of these Terms and Conditions. Furthermore, you agree to compensate us for any losses, damages, or costs, including reasonable attorney’s fees, resulting from your use of software robots, spiders, crawlers, or similar data-gathering and extraction tools, or from any action you take that places an unreasonable burden on our infrastructure.
14. Right of Retention
You may exercise a right of retention only if your claims arise from the same contractual relationship.
15. Inspection and Notification of Defects
The customer is obliged to inspect the goods upon delivery in accordance with statutory provisions. Any defects must be reported immediately, but no later than within 5 days of receipt of the goods. Statutory limitation periods apply. The notification of defects must be made by registered mail. Upon receipt of the defect notification, we have the right to have the reported defect or damage inspected by our own employees or experts of our choice.
16. Returns
For hygienic reasons, these products cannot be returned.
17. Right of Withdrawal
The customer may cancel their order within 24 hours without providing reasons. After this period, the purchase contract becomes legally binding. If the goods have already been shipped, they must be returned undamaged and in unopened, perfect condition. Otherwise, the obligation to accept the goods remains.

18. Special Features, Functions, and Events

In such cases, we will inform you accordingly. If you choose to participate in these offers, you agree that your use is subject to the additional or separate terms of use, rules, and/or policies.
19. Intellectual Property
All information and content available on the website, as well as its “look and feel,” including but not limited to trademarks, logos, service marks, text, graphics, button icons, images, audio files, data compilations, software, and their arrangement and organization (collectively the “Content”), is the property of We Love Lashes Switzerland and protected by international laws. These include, among others, laws safeguarding copyrights and trademarks. It is not permitted to use our trademarks and trade dress in any manner or for any purpose without our prior express written consent.
Neither the Content nor any part of the website may be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited for any purpose without our prior express written consent.
20. Applicable Law and Jurisdiction
Swiss law applies. Conflict-of-law provisions and the UN Convention on Contracts for the International Sale of Goods (CISG) are excluded. The exclusive place of jurisdiction is Zurich, Switzerland.
21. Final Provisions
Errors and price changes are reserved at any time. To the extent permitted by law, we assume no liability for improper handling or use of the products we sell. The statutory provisions of the Swiss Code of Obligations apply. The place of jurisdiction for disputes arising from the concluded contract is Zurich.
